Terms & Conditions

All products sold by Sunday Theory & Co. are custom-made and personalized to individual customer specifications. Customers acknowledge that personalized artwork is creative, interpretive, and artistic in nature.

While we strive to accurately capture the essence, appearance, and characteristics of the subject depicted, commissioned artwork is not intended to be an exact photographic reproduction. Minor artistic differences, creative interpretation, stylistic choices, aesthetic judgment, and subjective preferences shall not be considered defects or grounds for cancellation, return, refund, replacement, or chargeback.

Customers understand and agree that the artistic style presented on the website represents the intended design direction, but each artwork remains a unique creative work. Customers acknowledge that artwork created by Sunday Theory & Co. is an artistic interpretation based upon submitted photographs and that absolute likeness, exact replication, or subjective expectations regarding appearance cannot be guaranteed.
 

Customers are solely responsible for submitting photographs suitable for use in creating personalized artwork. Prior to placing an order, customers are encouraged to review the Photo Requirements & Guidelines page available on our website.

By submitting photographs, customers acknowledge and agree that:

• The quality of the final artwork is dependent upon the quality of the photographs provided.
• Low-resolution, blurry, heavily filtered, cropped, obstructed, poorly lit, distorted, edited, or otherwise unsuitable photographs may negatively impact the final result.
• Sunday Theory & Co. is not responsible for limitations resulting from the quality or condition of submitted photographs.

We reserve the right to request additional or replacement photographs where the submitted materials are unsuitable for production. Failure to provide suitable replacement photographs may result in delays, cancellation of the order, or inability to complete the requested artwork.

 

Customers may submit photographs, names, dates, text, personalization requests, reviews, feedback, testimonials, or other content (“Customer Content”) through the website.

By submitting Customer Content, you represent and warrant that:

• You own the content or possess all necessary rights, permissions, licenses, and authority to submit such content.
• The content does not infringe upon the intellectual property, privacy, publicity, contractual, or other rights of any third party.
• The content is lawful and does not contain defamatory, offensive, fraudulent, misleading, unlawful, discriminatory, or otherwise objectionable material.

Sunday Theory & Co. reserves the right to reject, remove, refuse, or cancel any order containing content that, in our sole judgment, violates these Terms or may expose the business to legal, reputational, operational, or commercial risk. Customers shall remain solely responsible for all submitted content.

 

By submitting Customer Content, customers grant Sunday Theory & Co. a limited, non-exclusive, royalty-free license to use such content solely for purposes reasonably necessary to:

• Create artwork;
• Fulfill orders;
• Provide customer support;
• Process revisions;
• Maintain records;
• Resolve disputes;
• Comply with legal obligations.

Except where required to fulfill an order or comply with legal obligations, Sunday Theory & Co. will not use customer-submitted photographs or artwork for marketing, advertising, social media, portfolio display, promotional materials, or public-facing content without the customer’s prior written consent.

 

Where applicable, customers will receive a digital proof or artwork preview prior to production. Customers are solely responsible for carefully reviewing all aspects of the proof, including but not limited to:

• Names;
• Dates;
• Spelling;
• Text;
• Design elements;
• Artwork placement;
• Overall appearance.

Approval of a proof constitutes final acceptance of the artwork design. Once approval has been provided, Sunday Theory & Co. shall not be responsible for errors, omissions, spelling mistakes, customization errors, or design elements that were visible in the approved proof. Customers acknowledge that production may begin immediately following approval and that further modifications may no longer be possible.

 

Customers will receive a digital proof for review prior to production. One (1) complimentary revision is included with each order. Additional revisions may be available at an additional fee, which will be communicated and approved prior to commencement of any additional work.

Customers are requested to review and respond to their artwork proof within seventy-two (72) hours of delivery. If no response is received within seventy-two (72) hours, Sunday Theory & Co. may issue one reminder notice and provide an additional seventy-two (72) hour response period. If no response is received following the reminder period, Sunday Theory & Co. reserves the right to deem the artwork proof approved and proceed with production and fulfillment of the order based on the most recently provided proof. The customer acknowledges and agrees that failure to respond within the specified timeframe constitutes authorization for Sunday Theory & Co. to continue processing the order.

Sunday Theory & Co. shall not be liable for delays, errors, dissatisfaction, requested modifications, or disputes arising from a customer’s failure to review, approve, or respond to proof communications within the applicable review period.

 

Unless otherwise stated, each order includes one (1) complimentary revision.

A revision is intended to address reasonable modifications to the artwork based upon the original photograph, personalization details, and approved design concept. Sunday Theory & Co. reserves the right to determine whether a requested modification constitutes a revision, redesign, or new artwork request.

Requests that significantly alter the original concept, require substantial redesign work, involve replacement photographs, or exceed the scope of a standard revision may be declined or treated as additional revisions. Additional revisions may be available at our discretion and may be subject to additional fees, which will be communicated to the customer before any additional work is undertaken. Any applicable revision fees must be paid before additional revision work begins.

Sunday Theory & Co. reserves the right to refuse excessive, unreasonable, repetitive, abusive, or impractical revision requests.

 

All prices displayed on the website are listed in the applicable currency shown at checkout and are subject to change without notice.

Sunday Theory & Co. reserves the right to modify pricing, product offerings, promotions, discounts, shipping rates, and related charges at any time. Customers agree to provide current, complete, and accurate billing information for all purchases.

By placing an order, customers authorize Sunday Theory & Co. and its payment processing providers to charge the selected payment method for all applicable charges, including product costs, shipping fees, taxes, duties, and any additional charges incurred in connection with the order. We reserve the right to refuse, limit, cancel, or decline any order for any reason, including suspected fraud, pricing errors, payment issues, technical errors, inventory limitations, or violations of these Terms.

While we make reasonable efforts to ensure that all information displayed on our website is accurate, Sunday Theory & Co. does not warrant that product descriptions, pricing, photographs, specifications, availability information, promotions, shipping rates, or other website content will be free from errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to cancel, refuse, or modify any order affected by such errors, whether or not the order has been submitted, confirmed, or payment has been received. In such circumstances, any payment received will be refunded in accordance with applicable law.

Submission of an order does not constitute acceptance of that order. Sunday Theory & Co. reserves the right to review, refuse, cancel, or limit any order at our sole discretion.

Orders may be cancelled or refused for reasons including but not limited to:

• Unsuitable photographs;
• Incomplete personalization information;
• Suspected fraud;
• Payment issues;
• Violations of these Terms;
• Operational limitations;
• Product availability issues;
• Technical errors.

If an order is cancelled prior to commencement of artwork creation, customers may receive a refund of amounts paid, subject to applicable processing fees and payment provider policies.

 

Customers are responsible for ensuring that all order information submitted at checkout is accurate and complete.

Requests to modify, update, or cancel an order must be submitted as soon as possible. Orders may be eligible for cancellation within twelve (12) hours of purchase, provided artwork creation, proof preparation, production, printing, manufacturing, packaging, fulfillment, or other order-processing activities have not commenced. Because products are custom-made and personalized, changes and cancellations may not be possible once artwork creation, proof preparation, production, printing, manufacturing, packaging, fulfillment, or other order-processing activities have commenced.

Sunday Theory & Co. reserves the sole right to determine whether an order is eligible for modification, cancellation, partial refund, store credit, or any other accommodation. Where cancellation is approved after work has commenced, Sunday Theory & Co. reserves the right to retain amounts necessary to cover artwork creation, design services, administrative costs, production costs, or other expenses already incurred.

 

All products are produced specifically for individual customers. Estimated production timelines are provided as general guidelines only and are not guaranteed.

Production schedules may vary due to:

• Order volume;
• Seasonal demand;
• Supplier operations;
• Manufacturing schedules;
• Equipment maintenance;
• Workforce availability;
• Public holidays;
• Customs processing;
• Shipping carrier performance;
• Circumstances beyond our control.

Sunday Theory & Co. shall not be liable for delays resulting from such circumstances.

Production will generally commence after artwork approval has been received or deemed approved in accordance with these Terms. Orders are produced and shipped by one of our trusted production partners. Items within the same order may arrive in separate packages.

 

 

Shipping estimates are provided for informational purposes only. Delivery dates are not guaranteed.

Sunday Theory & Co. shall not be responsible for delays caused by:

• Shipping carriers;
• Customs authorities;
• Import inspections;
• Weather events;
• Natural disasters;
• Transportation disruptions;
• Labor disputes;
• Government actions;
• Circumstances beyond our control.

Risk of loss and title for physical products transfer to the customer upon delivery of the shipment to the carrier. Customers are solely responsible for ensuring that shipping information provided at checkout is accurate. Additional shipping charges may apply where packages are returned due to incorrect addresses, failed delivery attempts, refusal of delivery, or similar circumstances.

 

Customers are solely responsible for any customs duties, import taxes, VAT, brokerage fees, tariffs, or other charges imposed by their local authorities. Sunday Theory & Co. has no control over such charges and makes no representations regarding the amount or applicability of such fees. Failure to pay applicable duties, taxes, or import charges shall not entitle the customer to a refund.

 

Customers must notify Sunday Theory & Co. within three (3) days of delivery regarding products that arrive damaged, defective, or incorrect. Where requested, customers must provide photographs and supporting documentation sufficient for investigation.

Sunday Theory & Co. reserves the right to determine, at its sole discretion, whether replacement, reprint, repair, store credit, refund, or other resolution is appropriate. Sunday Theory & Co. shall not be responsible for packages reported as lost, stolen, delayed, misdelivered, or otherwise affected after the shipping carrier has confirmed successful delivery to the address provided by the customer. Claims relating to shipping issues may be subject to carrier investigation procedures and timelines.

 

Due to the personalized nature of our products, all sales are generally final.

Returns, refunds, exchanges, replacements, or store credits shall not be granted for:

• Change of mind;
• Personal preference;
• Subjective dissatisfaction;
• Failure to review proofs;
• Customer-provided errors;
• Spelling mistakes supplied by the customer;
• Incorrect customization information provided by the customer;
• Delays outside our control;
• Variations inherent to artistic interpretation.



Refunds, replacements, exchanges, or store credits may be considered solely at our discretion in cases involving:

• Manufacturing defects;
• Production defects;
• Printing defects;
• Products damaged in transit;
• Incorrect items supplied by Sunday Theory & Co.

Any approved remedy shall be determined exclusively by Sunday Theory & Co.

 

All content appearing on the website, including but not limited to:

• Artwork;
• Product designs;
• Templates;
• Collections;
• Graphics;
• Logos;
• Branding;
• Text;
• Photographs;
• Product images;
• Website layouts;
• Design concepts;
• Marketing materials;
• Creative assets;

are owned by or licensed to Sunday Theory & Co. and are protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, displayed, modified, sold, licensed, published, reverse engineered, or otherwise exploited without prior written permission.

 

Unless expressly agreed otherwise in writing, products and artwork purchased from Sunday Theory & Co. are intended solely for personal, non-commercial use.

Customers may not:

• Reproduce artwork for resale;
• Commercialize artwork;
• License artwork to third parties;
• Use artwork in advertising;
• Use artwork in connection with commercial products or services;
• Create derivative commercial works based on artwork supplied by Sunday Theory & Co.

Any commercial use requires prior written authorization from Sunday Theory & Co.

 

Customers may choose to create an account on the website. Account creation is optional unless otherwise required for specific features or services. Customers are responsible for maintaining the confidentiality of account credentials and restricting access to their account. Customers accept responsibility for all activities occurring under their account.

Sunday Theory & Co. reserves the right to suspend, restrict, or terminate accounts at any time where we reasonably believe that account activity may violate these Terms, applicable law, security requirements, or the legitimate interests of the business.

 

Sunday Theory & Co. respects the privacy of customer-submitted photographs and artwork.

We will not use customer photographs, completed artwork, testimonials, reviews, or related content in advertising, marketing, social media, portfolio displays, promotional materials, or public-facing content without the customer’s prior written consent.

Where consent is granted, customers acknowledge that Sunday Theory & Co. may display such content in accordance with the scope of permission provided. Customers may withdraw future marketing permissions by contacting us in writing; however, such withdrawal shall not require the removal of materials already published prior to receipt of the withdrawal request.

 

Customers agree to contact Sunday Theory & Co. directly regarding any concerns, disputes, or issues relating to an order before initiating a chargeback, payment reversal, payment dispute, or similar claim through a financial institution, payment processor, credit card issuer, or third-party platform.

Where a customer initiates a chargeback or payment dispute, Sunday Theory & Co. reserves the right to provide relevant documentation in support of its position, including but not limited to:

• Order details;
• Proof approval records;
• Revision communications;
• Customer correspondence;
• Production records;
• Shipping records;
• Tracking information;
• Screenshots and related documentation.

Customers acknowledge that personalized products involve significant time, labor, design work, production costs, and fulfillment expenses that may be incurred before physical delivery occurs. Initiating a chargeback does not automatically entitle a customer to a refund.

 

The website, products, services, content, and related materials are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Sunday Theory & Co. makes no representations or warranties, express or implied, including but not limited to warranties of:

• Merchantability;
• Fitness for a particular purpose;
• Non-infringement;
• Accuracy;
• Reliability;
• Availability;
• Performance;
• Compatibility.

Sunday Theory & Co. does not warrant that:

• The website will operate uninterrupted or error-free;
• Defects will be corrected;
• The website will always be available;
• Communications will be free from delay;
• Products will meet every subjective expectation of a customer.

Customers acknowledge that personalized artwork is inherently creative and subjective.

 

To the fullest extent permitted by applicable law, Sunday Theory & Co., its owners, contractors, suppliers, service providers, affiliates, employees, agents, and representatives shall not be liable for any:

• Indirect damages;
• Incidental damages;
• Consequential damages;
• Special damages;
• Exemplary damages;
• Punitive damages;
• Loss of profits;
• Loss of revenue;
• Loss of business opportunity;
• Loss of goodwill;
• Loss of data;
• Emotional distress;
• Personal dissatisfaction;
• Other intangible losses.

This limitation applies regardless of whether the claim arises from:

• Contract;
• Tort;
• Negligence;
• Strict liability;
• Statute;
• Equity;
• Any other legal theory.

In no event shall the total liability of Sunday Theory & Co. exceed the amount actually paid by the customer for the specific order giving rise to the claim.

 

Customers agree to indemnify, defend, and hold harmless Sunday Theory & Co., its owners, contractors, affiliates, service providers, suppliers, employees, and representatives from and against any claims, demands, losses, liabilities, damages, judgments, settlements, penalties, costs, and expenses, including reasonable legal fees, arising from or relating to:

• Customer-submitted content;
• Violations of these Terms;
• Misuse of the website;
• Infringement of third-party rights;
• Fraudulent activity;
• Unlawful conduct;
• Violations of applicable laws or regulations.

This obligation survives termination of the customer relationship and continued use of the website.

 

Sunday Theory & Co. shall not be liable for any delay, interruption, failure, or inability to perform obligations arising from events beyond our reasonable control, including but not limited to:

• Natural disasters;
• Extreme weather;
• Floods;
• Fires;
• Earthquakes;
• Epidemics;
• Pandemics;
• Government actions;
• Regulatory changes;
• Labor disputes;
• Supply chain disruptions;
• Transportation interruptions;
• Customs delays;
• Utility failures;
• Internet outages;
• Cybersecurity incidents;
• Acts of war;
• Civil unrest;
• Terrorism;
• Any similar event beyond our reasonable control.

Where such circumstances occur, performance timelines may be extended without liability.

 

Sunday Theory & Co. may rely upon third-party providers for website hosting, payment processing, manufacturing, fulfillment, shipping, analytics, marketing, communication, and related services. We are not responsible for acts, omissions, interruptions, failures, delays, or policies of third-party providers. Use of third-party services may also be subject to the separate terms, policies, and conditions of those providers.

 

Customers agree not to:

• Use the website for unlawful purposes;
• Violate applicable laws or regulations;
• Upload malicious software or code;
• Interfere with website security;
• Attempt unauthorized access to systems;
• Collect customer information without authorization;
• Engage in fraudulent activity;
• Impersonate another person or entity;
• Infringe intellectual property rights;
• Harass, abuse, threaten, or harm others.

Sunday Theory & Co. reserves the right to suspend access, terminate accounts, cancel orders, and pursue available legal remedies where prohibited activity is suspected.

 

Sunday Theory & Co. reserves the right to terminate, suspend, restrict, or discontinue access to the website, customer accounts, services, or orders at any time and without prior notice where we reasonably determine that:

• These Terms have been violated;
• Fraudulent activity is suspected;
• Security concerns exist;
• Continued service would expose the business to unreasonable risk.

Termination shall not affect obligations accrued prior to termination.

 

If any provision of these Terms is determined to be unlawful, invalid, unenforceable, or otherwise ineffective, the remaining provisions shall remain in full force and effect. Any invalid provision shall be interpreted, modified, or limited to the minimum extent necessary to preserve its intended purpose while remaining enforceable under applicable law.

 

Failure by Sunday Theory & Co. to exercise or enforce any right, remedy, or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be made expressly and in writing.

 

These Terms, together with the Privacy Policy, Returns Policy, Shipping Policy, Photo Requirements & Guidelines, and any other policies expressly incorporated by reference, constitute the entire agreement between the customer and Sunday Theory & Co. regarding use of the website and purchase of products and services. These Terms supersede all prior understandings, discussions, communications, representations, and agreements relating to the subject matter herein.

 

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms, the website, or any purchase made through Sunday Theory & Co. shall be subject to the exclusive jurisdiction of the state and federal courts located in New York, United States. Nothing contained herein shall limit any rights that may be available to consumers under mandatory consumer protection laws applicable within their jurisdiction.

Sunday Theory & Co. reserves the right to update, revise, modify, replace, or amend these Terms at any time. Changes become effective immediately upon posting the revised version to the website unless otherwise stated. Continued use of the website following any modifications constitutes acceptance of the updated Terms.
